Terms of Use

These terms of use regulate access by the user of the website (hereinafter the "User") to the content provided by RBA HOLDING EDITORIAL, S.A. (hereinafter "RBA"). The mere use of the information contained on this website implies full acceptance of these Terms of Use, and as such we strongly recommend consulting them every time you return to this website, as they are updated constantly.

General Information
In compliance with the stipulations of Article 10 of Law 34/2002, of July 11 (the Law on Information Society Services and Electronic Commerce), you are hereby notified that the owner of the domain www.rba.es is RBA (Fiscal Identity Code A-08.694.689), the registered office of which is at Calle Pérez Galdós no. 34, Barcelona. RBA has the appropriate government authorization for its work, according to the regulations in force and their supervisory body, and is duly registered in the Barcelona Register of Companies, in Volume 4,673, on Sheet 154, Page B-50437, and the Register has been duly notified of the domain name www.rba.es.

Trading Conditions
The transaction forms on www.rba.es can be completed in the language that you wish; that notwithstanding, RBA cannot be held responsible for errors or the inability to meet a request that may arise from the use of an improper language.

Sending any order forms entails engaging in electronic commerce under the terms of the Information Society Services Law 34/2002. By virtue of said law, RBA hereby informs you that the proper sending of the correct and necessary data and the subsequent completion of the payment process will be the only formalities required to fulfill these trading conditions. The document in which these conditions are formalized will be stored in our offices for the legally compulsory period of time, and will be accessible for the purposes of access, rectification or cancellation. You may fill out the forms in any of Spain's official languages.

Intellectual and Industrial Property
The content of the website (URL), meaning texts, images, graphic design, source code, logos, trademarks, etc., is the exclusive property of RBA and are protected by regulations concerning Intellectual and Industrial Property, and any reproduction, modification, distribution or manipulation thereof is therefore prohibited.

RBA is the sole owner of all property rights, both intellectual and industrial and others analogous thereof, that the Website may incur. RBA reserves all rights to any Content, Services or other items belonging to it that may be included on the Website, including, but not limited to, any items that constitute the visual appearance, graphic image and other sensory stimuli in the web pages comprising the Website:

- The browsing architecture
- The source codes of web pages
- Images
- Recordings
- Computer programs
- Database

- Technology
- Logos and other distinctive emblems.

RBA reserves the right to update, modify or remove any information contained on its website, as well as the configuration, features and general conditions thereof, at any time and with no obligation to give any prior warning.

The company does not guarantee the lack of interruptions or errors in access to the Website, and will assume no responsibility for any technical problems or errors occurring during the Internet connection session.

It also provides no guarantee as to the absence of viruses or other items that could lead to alterations of your computer system (software and hardware) or to the electronic documents and files stored in therein, and as such it shall not be held liable for damage that could take place to users' computer systems, electronic documents or files.

Rights Reserved
The user undertakes to not remove, delete, alter, manipulate or in any way change the following:

- The notes, legends, indications or symbols that either RBA or the legitimate owners of the rights include in their properties regarding intellectual or industrial property (i.e., copyright, ©, ® and ™, etc.).

- The technical devices for protection or identification that may be contained in the Content (i.e., watermarks, digital fingerprints, etc.).

- Access, viewing and, where appropriate, downloading of Content and/or Services must always and under all circumstances be strictly for personal and noncommercial purposes.

RBA reserves all the rights related to intellectual and industrial property with regard to the items on its Website, and grants the user no other license or authorization for the use of its Property, other than that specifically stipulated in this clause.

Limitation of Liability
Regarding the Information: RBA cannot be held responsible for the truthfulness, accuracy, appropriateness, suitability, or updating of the information supplied through www.rba.es. The content of this page is of an informative nature, and as such RBA cannot be held responsible for the decisions made by the user based on the same, or any damages caused to the user or third parties based on information obtained on this website.

Regarding the Quality of the Service: The user acknowledges his/her awareness of the existence of viruses, worms and other harmful items on the Internet. It is the responsibility of user to avail him/herself of the appropriate tools for the detection and removal of these harmful computer programs, and RBA shall not be responsible for any damage caused to the computer equipment belonging to the user or any third parties during their visit to the website.

Regarding the Availability of the Service: Access to the Portal requires services and supplies from other information society service providers, whose reliability, quality, continuity and operations are beyond the control of RBA. Consequently, the services provided by means of the Portal may be suspended, cancelled or may be inaccessible at any given time. RBA shall not be held responsible for damages of any type incurred by the User as a result of errors or disconnections in telecommunications networks that lead to the suspension, cancellation or interruption of the Portal service while this is being rendered or beforehand.

Regarding the Content Accessed in or through the Portal: This Website provides access to links and other websites (hereinafter "Linked Sites"). In these cases, RBA acts as a provider of mediation services in accordance with the stipulations of the Information Society Services Law, and as such it can only be held responsible for the content and services supplied on the Linked Sites to the extent that it has real knowledge of their unlawful nature and has not acted with the due diligence to remove this content. If you consider that one of the Linked Sites includes unlawful or inappropriate content, you may notify RBA to that end, and the latter will act with all advisable diligence to remove the links. Moreover, RBA assumes no responsibility for the content and services offered on the Linked Sites, and thus cannot account for any damage caused due to their unlawful nature, quality, obsolescence, unavailability, error or uselessness.

Link Licensing
All links by third parties to this website must be to its home or primary access page.

Users and, in general, any individuals wishing to create a link between their website and the Website must meet the following conditions. Any proposed type of link other than that stipulated in this clause will require prior acceptance in writing from RBA.

The user may not reproduce or imitate, either fully or partially, the Website contents, or the graphic appearance thereof (the "look and feel"), or create frames or inline links to the RBA pages.

No browser, frame, environment or navigation bar shall be created on the Website pages.

No false, inaccurate, incorrect or denigrative declarations or instructions shall be made regarding the Website, RBA or any RBA Properties and, in particular, no statements or implications shall be made claiming that RBA is a cooperating partner and/or has in any way supervised or accepted the content or services offered or placed at the disposal of the website on which the link is established.

The website on which the link is created shall contain no trademark, trade name, establishment sign, name, logo, slogan or any other distinguishing emblem belonging to RBA, except for those signs included in the link itself or the other Properties that have previously been licensed in writing by RBA.

The website on which the link is created shall not contain information or content that is unlawful, contrary to public morals, generally accepted decency and public order.

RBA reserves the right to take legal action against those in breach of the following prohibitions:

The following are specifically prohibited:

- The use of any of the content and services for unlawful purposes or intent, prohibited in these Legal Conditions, which are harmful to the rights and interests of third parties, or which may in any way harm, disable, overload, damage or prevent the normal use of the services, computer equipment or documents, files and content of all types stored on any RBA computer device.

- The use of content and services that are protected by any intellectual or industrial property rights belonging to the company or to third parties, without the user having obtained the necessary prior authorization from the owners to make the use carried out or intended.

- The reproduction, copying, distribution, dissemination, changing or modification of the content, unless prior authorization has been given by the owner of the rights concerned or this is legally permitted.

The inclusion of viruses or other physical or electronic items that may harm or prevent the normal operation of the network, system or computer equipment (hardware and software) of RBA or third parties or which may damage the electronic documents and files stored in said computer equipment.

- Obtaining or attempting to obtain the content, using to that end measures or procedures other than those which, depending on the circumstances, have been placed at the user's disposition for this purpose in general, or those which are commonly used on the Internet to that end, provided that these do not entail any risk of damage or disabling of the Website, the services and/or the Content.

Legislation
All and each of the points in these Legal Conditions are governed by Spanish law. Spanish legislation will be applicable to all issues of a litigious nature related to this Website, and the Courts and Tribunals of the city of Barcelona (Spain) shall be competent to that end.
